O&R Files Suit to Reverse Decision Blocking Substation Project

Orange and Rockland Utilities, Inc. (O&R) has filed an Article 78 lawsuit seeking to overturn a Clarkstown Town Board resolution that has, in effect, blocked O&R’s long-term efforts to build a new electric substation in New City.

O&R urged the court to reverse and vacate the Clarkstown Town Board’s action and to order the Clarkstown Town Board to issue a Certificate of Appropriateness for the Little Tor substation project as required by Chapter 153 of the Town Code. That approval would permit O&R to return to the Clarkstown Planning Board to seek site plan approval for the project.   

 

O&R plans to invest approximately $30 million to build a new electric substation at the southwestern corner of South Mountain Road and North Little Tor Road in New City to address serious local electric service reliability issues in New City.
